Terms of Use (EULA)

These Terms of Use form a binding agreement between you and XMR Wallet governing your use of the XMR Wallet application. By downloading or using the app, you agree to these terms. If you do not agree, do not use the app.

1. The App Is Non-Custodial Software

XMR Wallet is self-custody software that helps you generate, store, and use Monero (XMR) keys on your own device. We do not custody, hold, or have access to your funds, your private keys, or your recovery phrase. We cannot move, freeze, recover, or reverse your funds or transactions. You, and only you, control your wallet.

2. Your Responsibility for Keys and Backups

  • You are solely responsible for safeguarding your recovery phrase, private keys, and device.
  • If you lose your recovery phrase and lose access to your device, your funds will be permanently lost and no one can recover them.
  • Always back up your recovery phrase and store it somewhere safe and offline. Never share it with anyone.
  • You are responsible for verifying every recipient address and amount before sending. Monero transactions are irreversible.

3. License Grant

Subject to these terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the app on Apple-branded devices that you own or control, as permitted by the Apple Media Services Terms and the Usage Rules in the App Store Terms. You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract the source code of the app, except to the extent that such restriction is prohibited by applicable law.

4. Acceptable Use

You agree not to use the app:

  • For any unlawful purpose or in violation of any applicable law or regulation;
  • To facilitate money laundering, terrorist financing, fraud, or any sanctioned or prohibited activity;
  • To infringe the rights of others or to interfere with the operation of the Monero network.

You are responsible for complying with the laws, tax obligations, and regulations that apply to you in your jurisdiction.

5. No Financial, Investment, or Tax Advice

The app may display market data such as price and volume for informational purposes only. Nothing in the app is financial, investment, legal, or tax advice. Cryptocurrency values are volatile and you may lose value. You use the app and transact at your own risk.

6. Third-Party Services and Networks

The app interacts with the Monero network, Monero nodes, the optional Tor network, and third-party market-data providers. We do not control these networks or services and are not responsible for their availability, accuracy, or conduct. Your use of them may be subject to their own terms.

7. Disclaimer of Warranties

The app is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the app will be uninterrupted, secure, error-free, or that it will always sync correctly with the Monero network.

8. Limitation of Liability

To the maximum extent permitted by law, in no event will XMR Wallet or its developers be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of funds, profits, data, or goodwill, arising out of or relating to your use of, or inability to use, the app — including loss resulting from a lost recovery phrase, a forgotten passcode, user error, or an irreversible transaction.

9. Apple App Store — Required Terms

These terms are between you and XMR Wallet only, and not with Apple Inc. They incorporate, and are consistent with, the minimum terms of Apple's Standard Licensed Application End User License Agreement; where these terms are silent, Apple's Standard EULA applies. Apple is not responsible for the app or its content. The following terms apply to your use of the app obtained from the Apple App Store:

  • Apple has no obligation to furnish any maintenance or support services for the app.
  • In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
  • Apple is not responsible for addressing any claims by you or a third party relating to the app, including product liability, legal or regulatory compliance, and consumer protection claims.
  • Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party intellectual property infringement claim relating to the app.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as a 'terrorist supporting' country, and are not on any U.S. Government list of prohibited or restricted parties.
  • Apple and Apple's subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, will have the right to enforce these terms against you.

10. Termination

This license is effective until terminated. Your rights under these terms end automatically if you fail to comply with them. Upon termination, you must stop using the app and delete it. Provisions that by their nature should survive termination will survive.

11. Changes to These Terms

We may update these terms from time to time. We will revise the "Last updated" date above. Your continued use of the app after changes take effect constitutes acceptance of the updated terms.

12. Governing Law and Contact

These terms are governed by applicable law, without regard to conflict-of-law principles, and apply except where local consumer law requires otherwise. For questions about these terms, email support@xmrwallet.app.
